A Surrey health-care building is facing a lawsuit from a person who claimed they slipped in some vomit and injured themselves on the strata corporation’s property.
Kamni Krishna Murti’s notice of civil claim filed in B.C. Supreme Court Aug. 14 by Preszler Law Firm claimed that, among other things, the owners of the building at 13737 96th Ave. failed to ensure “the premises would be free of vomit on the floor.”
Murti claimed they fell due to vomit on the floor on Jan. 5, 2023.
The building is across the street from Surrey Memorial Hospital.
An online search shows that the address is City Centre 1 Office Tower. Its website does not work, making contact for comment difficult.
The claim further asserted the owners knew or ought to have known that vomit on the floor would and did create a hazardous situation. The court documents stated the owners allowed vomit to accumulate on the floor and failed to remove it.
The claim said the area is one of high traffic and that those charged with operating the building failed to mark the vomit hazard.
The claim only identifies the strata corporation by number and does not identify the property management or maintenance companies other than as ABC Property Management Company and XYZ Maintenance Company.
The claim asserts multiple injuries as well as dizziness, nausea, emotional distress, chronic pain and fatigue.
Murti is seeking multiple damages in the negligence and breach of duty case.
None of the allegations have been proven in court.
